El Presidente de la UIM (Uniòn Internacional de Magistrados), Gerhard Reissner, con el apoyo de todo el Comitè de Presidencia de esa prestigiosa institución (Austria, Francia, Lituania, Portugal y Canadà)  nos ha hecho llegar la siguiente carta para la Sra.Presidenta de la Naciòn Dra. Cristina Fernàndez de Kirchner.

Your Excellency Madame President,

On behalf of the International Association of Judges (IAJ) I am  honoured to address you in order to respectfully communicate serious concerns about recent developments in Argentina.

 IAJ is the most representative global judges association composed of  80 free formed national judges associations of 80 countries on all five continents, independent from governments, political parties and other groups of influence on national or supranational level. IAJ has observer status with the United Nations, with the Human Rights Commission of UN, and with several other international bodies.

IAJ was informed by its Regional Section, which is the Ibero-American Regional Group, by the Judges Association of Argentina (Asociacion de Magistrados y Funcionarios de la Justicia Nacional Argentina) and by some international observers that Argentinian Parliament is discussing an amendment of the legal framework for the judiciary (Election of the members of the Council for the Judiciary ( ), jurisdiction of the Supreme Court et alt..)

The Presidency Committee of IAJ shares the view that the proposed amendments may weaken the judiciary, may infringe the principle of division and balance of powers and may evokes the danger of politicization of the judges. A Council for the Judiciary should be a puffer between the powers of state to avoid undue influence of the other powers of state on the judiciary, it should not be a gate to exercise such an influence.

There is no evidence at all that such kind of changes could contribute to an increase of the effectiveness of the judicial system, on the contrary it will reduce the trust in the judiciary and by that erase one of the pillars of the state.

Argentina, one of the founding members of the United Nations has committed itself to the Universal Declaration of Human Rights (Article 10) and Basic Principles on the Independence of the Judiciary adopted by the General Assembly of the United Nations. These and many other international standards guarantee the exercise of justice by independent judges. This independence needs an adequate framework.

May I therefore ask your Excellency Madame President, to use all your influence to avoid the above mentioned changes.  IAJ will carefully watch the results of this debate in Argentina. If requested the Presidency Committe will put the issue on the agenda of the next Central Councils meeting for an in depth look in the problem. If necessary the members of IAJ will inform the relevant political stakeholders in their respective countries and the authorities in the competent committees of the  United Nations.

I am convinced that you will understand these concerns, and by analyzing the mentioned aspect you will discover that what is promoted as a step forward might in fact be just the opposite. If IAJ, which has a lot of experience in many different countries and different legal systems can provide any assistance IAJ is most willing to do so.

Allow me to express my best wishes for you personally, for the judiciary of your country and for Argentina.

Re: Reforma Judicial

Su excelencia Señora Presidenta,
En nombre de la Asociación Internacional de Jueces (IAJ), tengo el honor de escribirle respecto a serias cuestiones acerca de los recientes sucesos en la Argentina.
La IAJ es la mayor asociación que representa globalmente a los jueces, se compone de 80 libres asociaciones de los distintos países en los cinco continentes, independiente de los gobiernos y de  los partidos políticos y de otros grupos de influencia nacional o supranacional.
La IAJ tiene status de observadora en las Naciones Unidas, junto con la Comisiòn de los Derechos Humanos de la ONU y con otros varios cuerpos internacionales.
La IAJ fue informada  por su Sede Regional del Grupo Iberoamericano, que integran  los jueces de la Asociaciòn de Argentina (Asociaciòn de Magistrados y Funcionarios de la Justicia Nacional) y por observadores internacionales  de que el Parlamento Argentino està discutiendo una enmienda  en la infraestructura del Poder Judicial (elección de los miembros del Consejo de la Magistratura), Jurisdicciòn de la Corte Suprema.

> El Comité de Presidencia de IAJ comparte la opinión de que las propuestas de enmienda pueden debilitar al Poder Judicial, violar el principio de división y equilibrio de poderes y pueden evocar el peligro de la politización de los jueces. El Consejo de la Magistratura debe ser un ente neutral  para evitar la influencia indebida de los otros poderes del Estado en el Judicial, no debe ser un òrgano para ejercer  influencia.
>  No hay  ninguna evidencia de que este tipo de cambios podrían contribuir a incrementar un sistema judicial màs eficiente, por el contrario, se verìa reducida la confianza en el sistema judicial y con ello se eliminarìa a  uno de los pilares del estado.
> La Argentina, miembro fundador de las Naciones Unidas se ha comprometido con la Declaraciòn Universal de los Derechos Humanos  (Artìculo 10) y los Principios Bàsicos en la Independencia Judicial adoptada por la Asamblea General de las Naciones Unidas. Este y muchos otros principios estándares de justicia son garantía internacional del ejercicio de justicia por jueces independientes. Esta independencia necesita un adecuado marco legal.
> Por lo tanto, Su Excelencia Sra. Presidenta le pido que utilice toda su influencia para evitar los cambios mencionados anteriormente.
La IAJ observarà cuidadosamente los resultados de este debate en Argentina.
Si el Comitè de Presidencia lo solicitara, se pondrá este punto en la agenda de la próxima Reuniòn Central de Consejeros para una profunda mirada a este problema.
Si fuera necesario los miembros de la IAJ informaràn de esta relevante política a sus respectivos países y  a las autoridades competentes del Comitè de las Naciones Unidas.
Estoy convencido que Usted entenderà estas cuestiones, y analizando los aspectos mencionados Ud. descubrirà que realizar un paso hacia adelante, en contrario de lo propuesto será posible.
La IAJ, tiene una vasta experiencia en muchos países diferentes y en diferentes sistemas legales, le puede proveer de asistencia, y està deseoso de hacerlo.

Permítame expresar mis mejores augurios hacia su persona, por la justicia de su país y por la Argentina.
